How To Stop Debt Collectors From Calling You?

Under the FDCPA you can stop debt collectors from calling you by sending them a cease and desist letter. In the letter, notify the collector that they should cease and desist any further communication with you. However, a cease and desist letter only applies to third party collection agencies and not the original creditors.

Once the letter has been received by the collection agency they can communicate with you only once via mail to let you know one of three things:

* All the attempts to collect on the debt will be terminated.

Or

* The debt collector is planning to take legal actions against you.

Or

* The debt collector is definitely going to take certain actions.

Remember to send the cease and desist letter to the debt collector via certified mail with return receipt requested. It will act as a proof that the letter was indeed sent by you and received by the collection agency. It is advisable to keep a copy of the letter.

Once the collection agencies receive the cease and desist letter, they may take a couple of weeks to remove your number out of their automated dialers. If you find the debt collectors communicating with you and treating you unfairly even after you have waited for them to remove your number then in that case you must seek punitive action against them.
